The task of deciding upon legal child custody matters can be an emotionally drawing one. It is emotionally drawing not only for the parents / guardians but also for the innocent child who doesn’t know what is happening while wars are being fought - either among the parents themselves or at court – on issues relating to who will get to raise the child, what the visitation rules should be like and other similar matters. Sometimes, the parents just come to a decision that is agreeable to both with a little help with a lawyer just to fill in the legal formalities. In other cases though, there are bitter wars fought over the custody of the child and the problem requires the intervention of a court of law where a ruling is passes that is deemed to be fair by the judicial system. Whatever be the case, the one thing that remains true is that sorting out details relating to legal child custody, visitation and other particulars is often a harrying and complicated affair.
When matters reach the court, legal child custody is usually presented to the parent who will be most likely to provide the child with a happy life and enough resources to fulfill all his / her needs. This does not mean just financial support but also how much time the parent can spend with the child to also provide him / her with emotional support and good upbringing.
The typical trend has been to award legal child custody to the mother and ask the
father to chip in with child support and give him some specific visitation
timings when he can see the child. However, of late more fathers too are winning
child support. The only thing that the court wants to see is the willingness and
the ability of the parent to be able to provide financial and emotional support
to the kid.
Laws relating to child support can be both simple as well as complicated. While
“best interests of the child” benchmark is simple to understand there are also
many more complicated and seemingly trivial details that can play a role in
legal child custody cases. Where laws are aplenty, lawyers are too. If you are caught
